Critics of the new antimonopoly movement often make “sky is falling!” claims about chilling startup funding. But @FTC's Nvidia/ARM lawsuit ended up yielding the biggest IPO of 2023, and DOJ's pushback on Adobe/Figma is set to yield the biggest VC-backed IPO of 2025.

FTC v. Meta: the US argued Meta has a monopoly in the “personal social networking” market, which it claims includes only Instagram, WhatsApp, Snapchat, and MeWe

The government wants to show the Meta CEO bought Instagram and WhatsApp to snuff out social media competition.

FTC v. Meta: in opening arguments, FTC lawyers accuse Meta of a “buy-or-bury strategy” to cement a social networking monopoly by buying Instagram and WhatsApp

The tech giant went to court on Monday in an antitrust trial focused on its acquisitions of Instagram and WhatsApp.

Huge congrats to the FTC case team, now officially the “trial team”! Interesting bit for procompetitive-justification nerds: Boasberg tossed Meta's argument that it needed to buy WhatsApp to get a strategic advantage vis-a-vis Google & Apple. “Gotta keep our monopoly” =/= a PJ.

There's lots to like in the historic US v. Google decision, but so far this may be my favorite: the court decisively rejects what I call the “output-welfare fallacy.” Power to reduce output is only one type of market power. And output is often a bad metric for digital markets. [image]

I'd frankly be shocked to see this complaint dismissed. This is almost certainly headed to trial.

FTC files a new antitrust complaint against Facebook, after a judge dismissed the first complaint in June; Facebook has until October 4 to respond

Narratives are important in antitrust litigation. The new complaint adopts more of a narrative structure, by weaving the allegations of conditional dealing into the “Industry Background” section. The old complaint focused more on FB's basic business model here. https://twitter.com/...

Another theme that's emerging: FB “failed” at competing on the merits, “failure” to innovate, etc. The strategy, if I had to guess, is to disabuse the reader of any notion that FB got so big because it's just so darn great. The old complaint never used “fail__” in this way. https://twitter.com/...

One part of Epic v. Apple that's a bit concerning: both sides hired experts who support the Supreme Court's badly misguided approach to two-sided markets. Perhaps unsurprisingly, much of their writing on the topic was funded by credit-card companies, as noted below. https://twitter.com/...
