4. These are not easy calls.  There are many tradeoffs, and people will always be angry with you.  It's easy to say all this from the cheap seats now, but I don't think these short-term gains are worth the long-term pain.  4/4

Here are my two (well, four) cents on Meta settling with Trump: This all concerns their First Amendment rights as a private platform.  1. Deplatforming around Jan 6 was the right call.  Things were very volatile, and he played a role in that.  1/4

3. Settling was a bad call long-term.  While I understand the political necessity now, this will likely put them in binds with public figures and world leaders in the long term.  It shows how they can be pressured to take action and what Republicans were crying foul about with the Biden admin. 3/4

I tackled Zuck's letter to Jim Jordan in this week's newsletter.  This is a tough one because I understand the reasons why they likely wrote the letter; it just sucks as what most people would like is to see Jordan be held to account for the mistruths and harassment he's inflicted on so many people - especially the researchers doing important work on the information environment.

Still digging in but seems like the common theme across the NetChoice and Trump cases is that defining things like what things a content moderation law applies to or what are official or not official acts is really hard.  Given Chevron we should expect judges to have to do that more going forward.
