New SEC Guidance clarifies that POW mining & some pooled mining are not securities. This is great....but its maybe not the big story. This guidance ALSO elaborates on a potential new taxonomy to be applied to digital assets & maybe some radical changes to the securities laws /1

included in the list are (here we go...): (1) pooling or aggregating CVC from multiple persons, wallets, addresses, or accounts. This would appear to apply to every DeFi protocol that pools assets from third parties. hm. /3

While it's notable that @KimKardashian settled with the #SEC, it's more interesting to see that the consent order (once again) includes conclusory allegations that the token at issue was a security without the SEC bringing a claim vs the issuer or giving the issuer /1
